Health and safety law affects every business day-to-day, and when something goes wrong the fallout can be serious: disruptive investigations, enforcement notices, reputational damage, heavy fines, and even prosecution of directors or senior staff. As a health and safety barrister and specialist regulatory advocate, I handle these investigations regularly, including fire safety matters under the Regulatory Reform (Fire Safety) Order 2005, and I focus on helping businesses and individuals achieve the best possible outcome when the HSE, local authorities, fire authorities or the Office of Rail and Road get involved. I have several years’ experience advising and representing businesses and directors, including past work on the Health and Safety Executive and ORR ‘A’ panel, and my cases have ranged from fatalities and serious injuries across multiple sectors to inquests, public inquiries (including advising a key witness in the Grenfell Inquiry), and related personal injury claims.

I represent clients at every stage of health and safety or fire safety matters, from early advice and investigations through notices (including appeals) and, where necessary, prosecution. I deal with threats of criminal proceedings and conduct cases in the Magistrates’ Court, Crown Court and High Court, advising on litigation funding where appropriate, and I handle matters ranging from minor breaches to serious incidents involving injury or death, including (rarely) gross negligence manslaughter. I can also advise on linked issues such as professional discipline and professional negligence, and where enforcement overlaps with other regulators or legal areas (planning, food safety, the Environment Agency, police law, data protection, or financial crime), I help manage the wider risk and strategy. I act for employers, contractors and public bodies (including NHS Trusts), coordinate closely where employment tribunal issues arise, and focus on minimising disruption while securing the best possible outcome.

Stuart Jessop has substantial experience, successfully representing and advising businesses in Food, Consumer, health and Safety and Product Safety, and Environmental law.
